"Get that crimefighter a cape. A naked vigilante in Hamilton -- who interrupted a midnight break and enter in the buff -- is accused of stripping the teenaged burglar to his underwear, tying him up and whipping him with a belt on June 1.
"The accused was sleeping and he was surprised by the intruder," Hamilton police Det.-Sgt. Tom Andrew said.
"If it had stopped at that point, then he would have used enough reasonable force." But he had a reason not to call cops -- he's wanted for alleged criminal activity in 1998 and 1999.

And police believe the 17-year-old was trying to get at the remnants of a hydroponic marijuana grow operation in the house on King St. E. in Stoney Creek.
After the teen was stripped, tied and whipped, he was duct-taped and held for about five hours, police say, then driven to Queenston Rd. and let go.
Cops got a search warrant for the home and allegedly found the teen's clothes and keys, hydroponic equipment and a small amount of drugs.
Jeremy Stephen Ramey, 25, is charged with robbery, possession of stolen property, assault, assault with a weapon and forcible confinement.
He's also been charged with failing to appear, uttering threats, mischief and assault from 1999, and possessing stolen cars from 1998.

Thats some funny stuff:lmao Reminds me of this thing that happened here last month. There was this house on fire, which was started by the guys grow op lights. He even admitted to having like 500 marijuana plants, but he didnt get charged. Not sure why, i guess the lack of evidence, since his whole house burnt to the ground...

You would think that the 17 year old kid would have waited till the guy was not home to break in, but NOOOO....

If a 17yr old intruder were to break into my house, and I was to harm him by beating him senseless, I would be charged with assault unless I have marks on me to prove that it was in self defense. Either way it would have to go to court. I remember one incident that hit the papers big here. A burglar broke into a house slipped on some water and knocked himself out. Needless to say- he got caught. The accused then went and sued the home owner for slipping on his floor. That is Canada. Oh well, if someone ever does break into my house, my 125lb German Sheppard will take care of it.

If they don't the defendant is likely to win anyway. The guy broke into your house and just by his presance caused battery. It'd technically be self defence as soon as the guy breaks into your house.
We do have funnier laws though. How about the one saying that if a province finds that a legislation it tried to have passed is essential to the preservation of it's cultural heritage (this really only applies if the law is rejected in senate) the province can opt to have the law take effect regardless of the senate's ruling.
Happens in Quebec all the time.

Blah, I'll opt to just shoot the ba$tard, no costly court hearings and it does wonders for thinning out the gene pool.
Another story of Canadian Justice. This happened about nine years ago in either Colbourne or Cobourg. A group of teens broke into a store with weapons and stole money. The store owner was distraught and got his registered 38spl revolver and kept it in his store for protection. A short while later, they come back to rob him again and flee with cash and goods. The owner then went out and took his revolver, shot the tire of their getaway vehicle and held them at gunpoint until the police arrived. Immediately, the store owner was arrested and charged with firing a firearm in a residential area, unsafe storage of a firearm, and a ton of other firearms laws. He was looking at a minumum of ten years in prison. The media immediately got a hold of this and the courts were flogged with petitions to have the charges dropped. This paid off as the charges were dropped to less severe ones. Still, the mental stress of facing ten years in prison for protecting yourself was probably greater than the one, from actually getting robbed. I know that we live in a great country, but the justice system really needs to be looked at.
