I received this email from my internet provider today. I only downloaded one of the files at the bottom and deleted the other while it was in transit. I don't feel like reading the whole thing. LOL

Dear Customer,

We are writing on behalf of Cox Communications to advise you that we have received a notification that you are using your Cox High Speed Internet service to post or transmit material that infringes the copyrights of a complainant's members. We have included a copy of the complaint letter. Pursuant to the provisions of the Digital Millennium Copyright Act ("DMCA"), which is codified at 17 U.S.C. § 512, upon receiving such notification, Cox is required to "act expeditiously to remove, or disable access to" the infringing material in order to avoid liability for any alleged copyright infringement. Accordingly, Cox will suspend your account and disable your connection to the Internet within 24 hours of your receipt of this email if the offending material is not removed.

Please be aware that the DMCA also provides procedures by which a subscriber accused of copyright violation can respond to the allegations of infringement and, under certain circumstances, cause his or her account to be reinstated. To do so, however, the response must meet certain criteria. Pursuant to section (g) of the DMCA (17 U.S.C. § 512(g)), you have the right to submit to Cox a counter-notification which, to be effective, must include the following elements:

(a) a physical or electronic signature of the subscriber;
(b) identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or disabled;
(c) a statement under penalty of perjury that the subscriber has a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled;
(d) the subscriberÂ's name, address, and telephone number and a statement that the subscriber consents to the jurisdiction of the Federal District Court for the judicial district in which the address is located.

In the event that you submit to Cox a counter-notification that includes these elements, Cox will forward your counter notification to the complainant and advise them that Cox will cease disabling access to the allegedly infringing material in ten (10) business days. Unless the complainant notifies us that it has filed an action seeking a court order to restrain you from engaging in the allegedly infringing activity prior to the expiration of those ten (10) business days, Cox will reactivate your account.

u should probably get that firewall back up so they cant trace ur ip (or get a tracer that deletes their hard drive when they hack into ur system to check ur ip). good thing i get rid f stuff as soon as it finishes downloading. i think u keep ur files on ur hard drive.......

or u could just stop downloading movies all together......oh crap!!! i better get rid of my movies too that r still on my hard drive

I believe this kind of discussion (pirated material) isn`t allowed on these boards. And does someone really need to spell it out for you? Stop downloading copyrighted materials.

edit: Not to sound mean but the point of that email is pretty clear after reading the first few sentances.

I agree with the other's. Get rid of the stuff on your hard drive and don't try to download any more movies. I know the motion picture industry is not going after people yet for pirated movies downloaded. They are waiting to see what happens with the recording industry and them going after people.

It was pretty much a warning to you.....they caught you this time...next time it might be with a court subpoena in their hands.

Get rid of the stuff...put up firewalls...do what you can. But this was serious and don't try it again...

1) Notice how in this thread i started with 1942 posts and ended with 1946. I JUST WON WORLD WAR 2! I think that's a good sign. LOL

2) My burner needs too sleep. I just burned 17 650MB-700MB CD's in just about an hour!

If I read the letter correctly, you're not in trouble for downloading the movies. You are in trouble because some program (eDonkey) shows that it is available for uploading off your computer.

Turn off the sharing feature of your P2P programs and burn the DVDs, then erase the movies poff the hard drive. Finally, and this is the biggie, follow the directions they provided to prove that you have done this.

If you ignore this, they will sue your parents!

Do you people not understand that you cannot mask the identity of your computer and/or network? Sure you can with very advanced techs, but I am willing to bet that you do not know how to do it. I would recomend stopping P2Ping for while as they will be watching your every move.

I would recommend heading over to Overclockers.com and read what Ed has been saying about this. The consequences can be very severe and you are not as anonymous as you might think.

A point. I believe McDonald's (or one of the restaurants) is currently giving away DVDs. The customer receives it for free. The royalty fees were paid by the gifter(restaurant) since they created the copy. They customer would not be liable to pay. How is this different from downloading the same video? The liability would accrue from the giving, not the receiving. Getting the video for free should not be illegal. Sharing it, without paying royalties on it, would be.

I hope this made some sense. I thought of several other scenarios as I was typing it, so I hope it's not too jumbled. :Wink

Since this whole thing has started I've given up my P2Ping. That's right, I traded music files. The biggest difference (and the thing that pisses me off the most), is that the files I traded and collected were music files that were impossible to find because they were either on out-of-print medias, or were never released, like commercial music...you know, the copyright-free stuff you hear in the background of commercials. Some of these songs are impossible to find without paying $600 and up for a limited edition ultra-rare LP that you'd probably never play anyhow for risk of damaging it. Sheesh, talk about missing out on a good thing...

well let me put it like this. if it about having CR things on ur computer, when i get busted i would be in jail all my life (lol). well there is a problem with that i mean how did they find out that u had the movies. i mean the CR law is right but ur ISP cant Tell u how to use ur Internet time or what to do .is like if i was to call one of those porn # but before i do i called my friend and we do 3 way. what is verizon suppost to send me an email and tell me u are shareing the Porn call with one of ur friend and the Porn company called us and told use that they going to sui us if u dont stop. think abou that!!!!.

beside what else can u use broadband for beside dling and playig games. well i have over XXXX songs on my computer and ontop of that i have like XX movies in my hdds and on cds i have splindle after splindle lol. and let not talk about anything else lol. i think i giving to much info. hope no FBI is surfing throught this forum lol

If u reallu have to use Kazaa, and want to make sure that no spyware is installed in ur com to track ur uploads, i recommand u to switch to Kazaa Lite. Its just a hacked verson of Kazaa that u get all ad ware removed and stuff

if i were u now, i would burn them on cds and then purge all those files out of the hdd, that is, if u reallyyy wan to keep ur stuff ie.. porn

Idea if you want to continue using kazaa: use the same name as everybody else. (for example, theres thousands of users using the name "K++_www.kazaaKPP.com", you get the point)

I had fun at work today - one of the girls there got busted with 10Gb of MP3s on her personal Network Drive - they got an email from the main Network manger offsite and all came running to me. "Mat what are we going to do?"

I am cool with most things , BUT, they were warned not o do it - it is harsh but you try explaining ot people that it is a WORK computer and as such you have to be careful - it is the company that will get fined, no the user.

I don't download much myself - I prefer the packaging of a nice CD. Having said that, if the Record Companies insist on charging a ridiculous price for a pice of Polycarbonate then tough. People have been telling that the price was too much for years yet they carried on screwing the consumer. Guess what? The customer learnt to Screw back! They are panicking now - hence the subpoenas!

However, I'd be more worried about the RIAA coming after you, now that they are trying to sue individuals.
