Microsoft Takes on Teen Over Web Site

VANCOUVER, British Columbia - Mike Rowe thinks it's funny that his catchy name for a Web site design company sounds a lot like Microsoft.


The software giant, however, is not amused.

"Since my name is Mike Rowe, I thought it would be funny to add 'soft' to the end of it," said Rowe, a 17-year-old computer geek and Grade 12 student in Victoria, British Columbia.

Microsoft Corp. and its attorneys have demanded that he give up his domain name, the Vancouver Province newspaper reported Sunday.

Rowe registered the name in August. In November, he received a letter from Microsoft's Canadian lawyers, Smart & Biggar, informing him he was committing copyright infringement.

He was advised to transfer the name to the Redmond, Wash.-based corporation.

"I didn't think they would get all their high-priced lawyers to come after me," Rowe said.

He wrote back asking to be compensated for giving up his name. Microsoft's lawyers offered him $10 in U.S. funds. Then he asked for $10,000.

On Thursday, he received a 25-page letter accusing him of trying to force Microsoft into giving him a large settlement.

"I never even thought of getting anything out of them," he said, adding that he only asked for the $10,000 because he was "sort of mad at them for only offering 10 bucks."

He said family and friends are backing him and a lawyer has offered to advise him for free.

He's also keeping his sense of humor.

"It's not their name. It's my name. I just think it's kind of funny that they'd go after a 17-year-old," Rowe said.

Company spokesman Jim Desler said Sunday, "Microsoft has been in communication with Mr. Rowe in a good faith effort to reach a mutually agreeable resolution. And we remain hopeful we can resolve this issue to everyone's satisfaction."

Ha, and I was just thinking about how I could always check when their domain name runs out and then buy it off "if" it expires.

They'd sue me, I'd win and they'll pay millions for the domain name.

I hope this guy takes it all the way... I'm sick of MS thinking they own everything related to computing.

This is a bit over the top...even for MS. I can understand a company trying to protect their name...but this is not even their name.

I do believe that HD tried to sue Honda over Honda making a motorcycle sound like a HD. HD lost the suit with the jury stating you cannot patent a sound.

My point being, Mike Rowe soft might sound like Microsoft but it's not spelled the same and the name Mike Rowe belongs to the owner of the site. I don't think MS will do anything more than embarrass themselves over this.

Microsoft can't take summing which isn't theirs to take. Shame on them! :bomb

I don't know what microsoft is thinking. Copyright laws do not apply to phonetic pronunciations. Microsoft can register its name as a trademark, but it only applies to the written form of the word. If something sounds similar, but is spelled differently It is not trademark infringement. Regardless of that, if spelled phoenetically, Microsoft would be MI| - cro| - so(ft, whereas because it is three words, mikerowesoft would be mi|k ro| so(ft, where |'s represent long vowels and ('s short vowels. This is even worse than when MS went after "Lindows." Yes, it's similar to Windows, but not identical. I don't know how microsoft could register windows anyway. As it is a common, real word in the English language, it is technically not a valid trademark, but they certainly have the money to pay a few people off. I have windows all over my house. I guess microsoft will sue me next :Roll Eyes. Mike Rowe registered the domain name. He is the owner, and if microsoft insists on buyin it, he can name any price he wants. I rather seriously doubt his website is causing microsoft any loss of revenue, but showing the world again just how stupid they are might hurt billy g's bottom line.

It is the state of Litigation in the US that is to blame. Common sense no longer applies.

Do you know what and UGG boot is?

They were invented in AUstralia 30 years ago and sell everyawhere.

An American company started selling them and has now copyrighted the name.

THe clincher is.........................They don;t sell Ugg boots anymore but are still sueing the Australian manufacturers who invented it
