City misses out on lotto windfall
Winnings not taxable on outdated city charter
SOUTH EUCLID, Ohio (AP) --Rebecca Jemison, who emerged as the true winner of last month's $162 million lottery drawing, is suddenly even richer. This Cleveland suburb is suddenly much poorer.
South Euclid city officials were stunned to learn that they can't collect $1.4 million in income taxes from the winning Mega Millions ticket since the city charter wasn't updated to include lottery winnings as taxable income.
"It's not a good day for the city," Mayor Georgine Welo said Monday. "We were all excited until we went to go for the money and learned that we are not entitled to it. We are very saddened by the news."
Rebecca Jemison took the lump sum payment option of the $162 million jackpot, walking away with $67 million. Now, she's $1.4 million richer.
The news came at a bad time for South Euclid, which laid off six workers and made other cuts to help bring its $16.5 million budget down to $13 million, Welo said. The city had planned to use the windfall to rehire some workers and improve parks and recreation programs.
City Law Director Michael Lograsso said former Mayor John Kocevar's administration failed to act on a 1996 letter from the Regional Income Tax Agency advising the city to amend its charter if it wanted to tax lottery winnings.
That year, the Ohio Supreme Court ruled that in order for cities to collect the tax, they would have to specifically state "lottery winnings" as taxable income in their charters, Lograsso said.
The tax mix-up is the latest plot twist in an unusually eventful lottery drawing. Days after the December 30 drawing, another woman filed a police report saying she lost the winning ticket and was later found guilty of filing a false police report.

Yeah just like always someone has their hand out wanting money,
money, money, from anyone that get's a little extra bit of it like
Federal tax, state tax, city tax, or whatever they can come up
with to collect it from you, tax, tax, tax, tax, :mad: :Nope :Crying :Sigh :surrender :surrender

If I was her I'd work out some plan - get a good accountant and offer to pay the tax but get it offset so it comes back to her.
Brownie points plus good for the soul (and wallet)
Mind you IMHO I don;t see why you should have to pay Tax on the Lottery winnings

it's a governement thing here. They try to classify anything you make... even if its clams... as taxable income :spin

I would just donate the money. If I were the winnder I would be overwhelmed with $67 million, and it's sad to see a city lose it's value because of ME.
Putting it this way:
With donating to city, paying off parents car, my car and house I would still have 65 million left (and then some). So there you have it...be nice to people :p

I agree it's alot of money. Heck... i'd donate a buch of it and save the rest. pay off my mum's debts and get her a new car. The explorer isn't doing too well these days. I'd be able to afford a car and get somewhere. Hey.... maybe i'd be able to afford the insurance. :jawsdown
I do admit I put in 5 bucks each drawing for the lottery. If I win... I have to split it 33/33/33
33% for my aunt
33% for my mom
33% for me
Dad gets NONE. Reasons I'm not going to state.

If I won the lottery???
I would give money away to certain charities. Also take my family on one of those "Round the World" crusies in HIGH fashion. Stay in the best rooms on the ship, spend money in ports of call...I would have a blast.
Then come back home and build a house. Don't know if I would move back to Chicago....I might buy a place in the Gold Coast, but make my permanent home either in NC or Flordia.
I would give money to my folks, in laws and my brother. And probably have to give something to my other family members to keep peace. I mean if I don't give them anything how could I show my face at the next family picnic. The tension there would be so thick you could cut it with a knife....
When the Mega Millions gets into like the 100 million range my team at work pitch in and buy a ticket....
