First off, the parents are responsible.

1) they left their kids at home ALONE with no supervision.

2) they 7-year-old was obviously not taught properly to take care of a younger child, despite legal requirements.

3) the boy had not been taught proper behavior, especially with handling his sibling.

Again, I stress... I'm raising my kids BECAUSE if good parents didn't do it, we'd have nothing to balance out all of the psychos that the world is raising.
